One.- Ownership of the Portal or Shop www.solidcreaciones.es

Browsing the Portal, using and/or purchasing any of the products in the Shop implies acceptance as a User, without reservation of any kind, of all the General Terms of Use of the Portal, the General Terms of Sale and, where applicable, any Specific Terms that may be established for the purchase of services or products.

For the above purposes, a User is anyone who browses the Portal and/or uses the services included in the Shop or purchases the services or products offered in the Shop.

These General Terms shall apply both to the promotional and information activity carried out through the Portal and to the purchase of goods and/or the provision of services offered in the Shop, so that they shall govern at all times both simple browsing of the Portal and the purchase of goods and/or provision of services offered in the Shop, although the latter shall be governed by these General Terms of Use, by the applicable General Terms of Sale and by any specific terms that may be established.

Two.- Changes.

SOLID CREACIONES reserves the right to unilaterally modify, at any time and without prior notice, these general terms and any specific terms that may be established; the configuration, presentation and design of the portal or any of its elements; the general or specialised information and content provided; and, in general, any other circumstances not expressly listed, including the cancellation of the portal or any of its elements. Once any such modification has been implemented on the portal, any subsequent access by the user shall constitute unconditional acceptance of it.

Without prejudice to the above, SOLID CREACIONES also reserves the right to unilaterally withdraw, in whole or in part and at any time, free access to the portal or free use of its information and content. In this case it will inform users of this circumstance on the portal’s home page sufficiently in advance.

Three.- Rules for using the portal

Restrictions

The User undertakes to use the portal in strict compliance with these general terms and any specific terms that may be established, as well as with the law, custom and public order. Consequently, the user, by way of example and without limitation, undertakes:

Not to use the portal, or the elements, information, content and services it contains, in breach of the general and/or specific terms, the law, generally accepted good practice or public order.
Not to gain unlawful access to the portal or to third-party computer systems, nor to spread programs or computer viruses that may damage any computer equipment or systems, regardless of who their owners are.
Not to send, under any circumstances, advertising or commercial communications of any kind, nor electronic messages not requested or previously consented to by their recipients, whether individual messages or chain messages. The user also undertakes not to collect or use any distribution lists that may be accessible from the portal, nor to transfer those lists or the data they contain to third parties under any title, whatever the purpose.
Not to carry out activities that in any way cause or may cause harm or damage of any kind to SOLID CREACIONES
Not to infringe, in such use, any rights of any kind belonging to third parties.
Not to carry out acts that limit or prevent other users from accessing and using the portal under suitable conditions.
Not to use mechanisms other than those expressly enabled or recommended on the portal to obtain the information, content and services it contains, where obtaining them is possible because it has been authorised or permitted by SOLID CREACIONES
Not to establish links between any website, including the user’s own, or any other site or space accessible on the Internet, and the SOLID CREACIONES portal, unless express written authorisation has been given by SOLID CREACIONES, and under the conditions it has established in each case. Any user who fails to comply with the above shall be solely and exclusively liable for any loss or damage of any kind caused as a result, whether to SOLID CREACIONES or to third parties.

Four.- Intellectual and Industrial Property

All intellectual and industrial property rights both in the elements of any kind that make up the portal — including, by way of example and without limitation, interactive screen designs, graphic designs, drawings, image or sound files, photographs, infographics, user interface, thesauri, indexing systems, etc. — and in the general or specialised information, services and, in general, all content offered on the portal, including the so-called “project sheets”, “questions and answers” and “product help”, required for their public communication, belong exclusively to SOLID CREACIONES or have been licensed to it by their respective owners. SOLID CREACIONES reserves all rights and does not grant any licence or authorisation to use them.

The user undertakes not to infringe, under any circumstances, the rights referred to in the preceding paragraph, and to use the portal, with its various elements and content, exclusively for private use. Consequently, the user, by way of example and without limitation, may not use the portal for business or commercial purposes; nor reproduce, copy or distribute in any way the elements, information, services or content it contains; nor facilitate or allow third-party access to such elements, information, services and content through public communication in any form; nor circumvent, remove, modify or tamper with the technical protection devices of the portal or its elements; nor transform or modify them; nor remove, modify or tamper with, by any means, the “Copyright” of SOLID CREACIONES, regardless of whether such acts affect the “©” symbol, the word “Copyright”, the year of first publication of the work or the company name of SOLID CREACIONES, jointly or separately, or any other element that in any way identifies the intellectual property rights of SOLID CREACIONES.

Five.- Liability

SOLID CREACIONES shall only be liable for damage the User may suffer as a result of using the Shop where such damage is attributable to wilful misconduct by this company. The User acknowledges and accepts that use of the Shop and the purchase of the products offered in it are entirely at the User’s own risk and responsibility.

SOLID CREACIONES shall not be liable for any loss arising from, by way of example and without limitation, interference, omissions, interruptions, computer viruses, faults and/or disconnections in the operation of this electronic system or in Users’ computer equipment caused by circumstances beyond the control of SOLID CREACIONES that prevent or delay the provision of services or browsing of the System; delays or blockages in use caused by deficiencies or overloads of the Internet or other electronic systems; damage that may be caused by third parties through unlawful interference beyond the control of the Shop and not attributable to SOLID CREACIONES; any discrepancies in the information, documentation and/or other content of the Shop between the electronic version and the printed version; or the impossibility of providing the Service or allowing access for reasons not attributable to SOLID CREACIONES, due to the User, third parties or force majeure.

SOLID CREACIONES does not, as a general rule, monitor how Users use the Shop. In particular, SOLID CREACIONES does not in any way guarantee that Users will use the Service in accordance with the law, these General Terms, generally accepted morals and good practice and public order, nor that they will do so diligently and prudently.

Six.- Data Privacy Policy

The User expressly accepts the inclusion of the data collected while browsing the Shop, or provided by filling in any form, as well as data arising from the commercial relationship and/or delivery of the Products purchased, in one or more automated personal data files owned by SOLID CREACIONES. During the data collection process, and at each point in the Shop where such data is requested, the User will be informed, either by a hyperlink or on the form itself, whether providing such data is mandatory in order to access the areas, services or resources of the Shop where the data is requested.

The purpose of collecting the above personal data and processing it automatically in the corresponding files under the responsibility of SOLID CREACIONES is to provide and manage the services the user has registered for, to improve and extend them and to adapt them to the user’s characteristics and preferences based on the study and segmentation of the personal and commercial information held in our files as a result of their access to the Shop, as well as to inform about and market the products offered in the Shop and to carry out promotional and advertising activities by any means, including sending messages through any system, that may be of interest to the user, and/or to allow personalised browsing.

With regard to the data collected as described above, the user may exercise the rights recognised in Regulation (EU) 2016/679 (GDPR) and in Spanish Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPD-GDD), in particular the rights of access, rectification, erasure, objection, portability and restriction of processing, as well as the right to withdraw consent to the transfer of their data, by sending a request to SOLID CREACIONES by email at info@solidcreaciones.es

The User must send requests to exercise the aforementioned rights of access, rectification, erasure and objection regarding any of the companies to which personal data is transferred to this same email address, in accordance with the preceding paragraph.

SOLID CREACIONES undertakes, when using the data included in the file, to respect its confidentiality and to use it in accordance with the purpose of the file, as well as to comply with its obligation to store it and to take all measures to prevent its alteration, loss, processing or unauthorised access, in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPD-GDD). Nevertheless, the User is informed that these security measures are not unbreakable or invulnerable.

Seven.- Communications.

For the purposes of the General Terms of Use of the Portal, the General Terms of Sale and, where applicable, any Specific Terms that may be established, all communications the User needs to make to SOLID CREACIONES shall be sent to Customer Service by email at info@solidcreaciones.es.
Communications from SOLID CREACIONES to the User shall be made using the details provided by the User when making a purchase in the online Shop. The User expressly accepts the use of the email address provided by the User as a valid means of sending such communications.

Eight.- Applicable Law and Jurisdiction.

These General Terms of Use of the Portal, General Terms of Sale and, where applicable, any Specific Terms that may be established are governed by Spanish law.

To resolve any dispute or controversy relating to their application, interpretation or performance, the parties expressly waive any other jurisdiction that may correspond to them and submit to the Courts and Tribunals of Valencia, Spain.

Nine.- Discount Coupons

You can use discount coupons to get a discount on your Orders on the Website.
We may send you emails with discount coupons. We are not responsible for any errors in the recipient’s email address.
Discount coupons are transferable and you may assign their use and your rights to another person.
In the event of fraud, attempted deception or suspected illegal activity relating to the purchase or redemption of discount coupons on the Website, we are entitled to refuse the use of discount coupons.
We are not responsible for the loss, theft or illegibility of gift vouchers or promotional vouchers.

Conditions for redeeming promotional vouchers

From time to time we issue discount coupons that you can use on the Website. We will send them to you by email or via social media and they can only be redeemed on the Website. They cannot be used in our physical shops.
Discount coupons are only valid for the period stated on them, are single-use and cannot be combined with other promotional vouchers, offers or discounts on the website (including Flash sales and/or Outlet offers). They may not apply to certain brands.
If the amount of your Order is lower than the value of the promotional voucher, the difference will not be credited or refunded.
Discount coupons do not earn interest and have no cash value.
If the amount of your Order is higher than the value of the discount coupon, you must pay the difference using another payment method.

Discount coupons cannot be combined with other offers.

General terms of sale

One.- General provisions.

These General Terms of Sale, together with any Specific Terms that may be established, shall govern the contractual relationship between SOLID CREACIONES and each User who purchases the products and/or services offered through the website https://www.solidcreaciones.es/, which it owns (hereinafter, the Shop or the Portal).

These General Terms of Sale are based on the provisions of Law 34/2002 on Information Society Services and Electronic Commerce; Law 7/1998 on General Contract Terms; Royal Decree 1906/1999 regulating Telephone or Electronic Contracting with General Terms, implementing article 5.3 of Law 7/1998; Law 26/1984, the General Law for the Protection of Consumers and Users; Law 7/1997 on Retail Trade; Royal Decree-Law 14/1999 regulating Electronic Signatures; and any other legally applicable regulations.

Browsing the Portal, using and/or purchasing any of the products in the Shop implies acceptance as a User, without reservation of any kind, of each and every one of these General Terms of Sale, the General Terms of Use of the Portal and, where applicable, any Specific Terms that may be established.

For the above purposes, a User is anyone who browses the Portal and/or uses the services included in the Shop and, in particular, purchases the products or services offered through the Portal.

SOLID CREACIONES informs that the steps to purchase goods and/or services offered in this Shop are those described in these General Terms of Sale, as well as any other specific steps indicated on screen while browsing, so the User declares that they know and accept these steps as necessary to access the products and/or services offered on the Portal.

The products and/or services offered in the Shop, together with their characteristics and price, will be shown on screen. In addition to the price, and before confirming the order, the total delivery costs to the User’s address will be shown on screen, which shall always be borne by the buyer. Prices shown on screen are in euros and include VAT and any other applicable tax, and shall at all times be those in force, barring typographical errors.

Offers will be clearly indicated on screen. SOLID CREACIONES reserves the right to decide at any time which products are included and offered to Users through the Shop. Accordingly, SOLID CREACIONES may at any time add new products to those included in the Shop, and, unless otherwise stated, such new products shall be governed by the General Terms in force at that time. Likewise, SOLID CREACIONES reserves the right to stop providing access, at any time and without prior notice, to any of the products offered in the Shop. The minimum price commitment does not apply to items sold through the Portal.

Product photographs are not contractual. The dimensions, colours and characteristics of the Shop’s products shown on the Portal are approximate and are therefore not entirely reliable. Consequently, if the User wishes to check the exact appearance and technical conditions of the Product, they must do so before purchasing the product through the Portal, since for returns on technical grounds of this kind, shipping and return costs shall be borne exclusively by the User.

Products for which current regulations so require must be installed by companies or professionals holding the relevant administrative qualification, authorisation or certification.

Two.- Procedure for purchasing Products in the Shop.

To purchase products in the Shop, the User must follow the instructions shown on screen and accept the purchase by completing those instructions, which in turn implies reading and irrevocably accepting all these General Terms of Sale and Terms of Use of the Portal, as well as any Specific Terms that may exist. The User will browse the different sections and select the product or products they wish to purchase by clicking on the “add to order” link. The products selected by the User are added to what is called “my order”. At any time and at the end of the purchase process, once all products have been chosen, the User must click on the “my order” link and then click on “checkout”, and will be redirected to a page showing the following content in relation to the successive purchase steps:

Purchase summary:
After clicking on the “checkout” link, the User will be asked for the following details: a. delivery address — products will not be delivered to PO boxes or public places — including an email address that the User must provide; and b. billing details (which may not need to be entered again if they are the same as the delivery details).
To make the payment, the User must follow each and every one of the instructions shown on screen, providing the information requested.

All data provided for these purposes is encrypted to guarantee maximum security and is hosted on a secure server certified under the SSL protocol.
SOLID CREACIONES accepts payment by several methods: credit card, bank transfer, Apple Pay and Google Pay. All payment data is processed securely through the enabled payment gateways, in accordance with their respective Terms of Use and Privacy Policies.

Five.- Returns.

The User has fourteen (14) calendar days from receipt of the product to exercise their right of withdrawal, without having to give any reason and without any penalty, except in the legal exceptions indicated below.

To exercise this right, the User must notify SOLID CREACIONES by email at info@solidcreaciones.es before the end of that period and return the product within a maximum of 14 calendar days of that notification, in its original packaging and in perfect condition.

SOLID CREACIONES will refund all payments received, including delivery costs, without undue delay and in any event within a maximum of 14 calendar days from being informed of the decision to withdraw, and may withhold the refund until it has received the returned product.

In accordance with article 103 of Spanish Royal Legislative Decree 1/2007, products made to the customer’s specifications or clearly personalised are excluded from the right of withdrawal. For these products, returns will only be accepted in the event of a manufacturing defect or damage caused during transport.

– Complaint Forms.

In accordance with current regulations, official Complaint Forms (Hojas de Reclamaciones) are available to consumers.
